Privacy Policy

1. Introduction

Whizz Kids Nursery is a private nursery having its trading office Scout Way, Mill Hill, London NW7 3JW.

Whizz Kids Nursery is regulated by UK Ofsted (The Office for Standards in Education, Children’s Services and Skills) with full permissions to provide nursery education services to children in the UK.

This Privacy Policy has been prepared by Whizz Kids Nursery to explain how we meet our obligations under the General Data Protection Regulation (GDPR) legislation on Data Protection enforced on the 25th May 2018.  "You" and "your" (means the parents / children) who apply to use our services.

This Policy (together with our Website Terms and Conditions of Use (www.whizzkidsnursery.com) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

PLEASE READ THE FOLLOWING CAREFULLY TO UNDERSTAND HOW WE ACQUIRE, PROCESS AND STORE YOUR PERSONAL DATA AND YOUR RIGHTS OF ACCESS and ERASING OF YOUR DATA.

2. Information We May Collect From You

We may collect and process the following data about you:

Information that you may provide by filling in the registration form on www.whizzkidsnursery.com (our "Site"). This includes information provided at the time when you request a nursery place, or complete the acceptance application from on our Site, or request further services.

Correspondence and records of all contact with you, including any discussions; please note that calls between us may be recorded and/or monitored.

Surveys that we use for research purposes, which we may ask you to complete, although you are under no obligation to respond.

Details of your visits to our Site and the resources that you access (this is partly acquired via our use of cookies; please refer to paragraph 7 below for further information about these).

Information from third parties in respect of you which may include your GP, schools you apply for, medical professionals, child care providers, local authorities or staff working for you.

3. How We Use Your Information

Whizz Kids Nursery collects and processes your data in order to provide you with access to nursery places and other services and to help prevent child protection.

We use information held about you in the following ways, namely to:

process your nursery application;

apply first school entrance tests or first school application;

verify your identity and the identity of your spouse, partner or other child care providers;

manage and maintain your records at the nursery;

collect nursery fees via the Site;

notify you about weather condition affecting the nursery or nursery events / activities;

communicate with professional bodies i.e. GP, Hospital based on your consent; and

notify you about changes to our service.

Also we provide you with, or permit selected third parties, information about services which may be of interest to your needs i.e. child specialists.

Your data may also be used for other purposes for which you give your specific permission or, in very limited circumstances, when required by law or where permitted under the terms of the Act.

4. Storing Your Personal Data

We will store and process your information securely as we deem appropriate, for example on our computers and servers for a reasonable period at least for the period required by law.

All information you provide to us is, as far as reasonably practicable, is stored on our secure servers. Any financial information, such as credit/debit card numbers will be encrypted using specific security software. We ask you not to permit anyone to use your name.

In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. Further information is provided below under heading 5 'Security'.

Retention of Data
We intend to hold your data throughout the period of our engagement with you as parents / child and applying the following post-client policy:

  • In the case of the termination / completion of our engagement, we will maintain your data for 6 years.

5. Security

Our Site is available to general public.  You will be responsible for any instruction which we receive and act on, even if it was not given by you.

Unfortunately, the transmission of information via the internet or Smart Phone or similar device is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Site; any transmission is at your own risk. Once we have received your personal data, we will use strict procedures and security features to try to prevent unauthorised access.

When nursery / other fees are paid by you via our Site, we do not hold any credit/debit card details.  Such details are held by the card payment merchant Elavon who is regulated and licensed by the Financial Conduct Authority (FCA).  However any financial information will be encrypted using specific security software implemented by Elavon.  We ask you not to permit anyone to use your credit/debit card.

In the event of there being a data breach Whizz Kids Nursery undertakes to inform you (as well as any relevant authority) not later than 1 month of the nursery becoming aware of the breach.  Whizz Kids Nursery does not believe that the data it holds give rise to any need to report a breach to the Information Commissioner Office (ICO) within 72 hours but it is conscious of the possible need to do so.  Paper records are also held securely.

6. Disclosure of Your Information

We may disclose your personal information to third parties:

To process your first school entrance tests or first school entrance application, or any of the services you have requested.

To prepare or send any communications to you.

To prepare or send any communications to third parties you have requested e.g. GP, child specialist, other schools, Ofsted or local authorities.

To assist us in connection with any of our administrative or nursery functions, or in the provision of any of our services to you.

If Whizz Kids Nursery or substantially all of its assets, are acquired by a third party, in which case personal data held by us about our parents / children will be one of the transferred assets.

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Website Terms and Conditions of Use and other agreements; or to protect the rights, property, or safety of Whizz Kids Nursery, our parents/children, or others. This includes exchanging information with other authorities and organisations for the purposes of fraud or child protection.

We may give information about you to the following:

Law enforcement agencies in circumstances where we are required to do so by law;

Persons and government entities which provide a service to us or are acting as our agents, on the understanding that they will keep the information confidential.

An explanation of WHAT cookies are and how we use them - a cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps web applications to respond to you as an individual by gathering and remembering information about your preferences and which pages you visit.  Some cookies only exist whilst users are online but persistent cookies – which are not session-based – remain on the user's computer, so that he or she can be recognised as a previous visitor when he or she next visits our website. A cookie in no way gives us access to your computer or any information about you, other than the information you choose to share with us.

We use cookies to collect information about your computer, including, where available, your IP address, operating system and browser type, for system administration and to report information to our advertisers. The cookies we use, along with an explanation of what they do, are set out below.

We do not store sensitive information such as account numbers or credit/debit card details in persistent cookies, and cookies in themselves do not contain enough information to identify you.

In addition to using cookies, we might also use web tools to collect information about your browsing activities whilst on our website. In this respect the information that is provided is similar to the information supplied by cookies, and we use it for the same purpose.

Any information that we acquire about you using cookies [or web tools] is subject to the same restrictions and conditions as any other information we collect about you.

The Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011 enquires that cookies can only be placed on a computer where the user has given their express consent. You can choose to accept or decline cookies when you first access our Site. We require you to indicate your choice via an automated "pop-up" box, which explains the cookies we use and what we use them for. Most web browsers automatically accept cookies, but you can also usually modify your browser setting to decline cookies if you prefer. The Site may contain links to other websites or services that are not owned or controlled by Whizz Kids Nursery. This Policy only applies to information collected by the Site. We have no control over these third party websites, and your use of third party websites and features are subject to privacy policies posted on those websites. We are not responsible or liable for the privacy or business practices of any third party websites linked to the Site. Your use of third parties' websites linked to the Site is at your own risk, so we encourage you to read the privacy policies of any linked third party websites when you leave one of the Site.

8. Your Rights

You have the right under the GDPR legislation:

Complaint – Ideally we would wish to try to deal with complaints itself before recourse to any external authority and asks parents to submit complaints via email or post but it is open to clients to submit a complaint at any time to the Information Commissioner Office (ICO).  Its postal address is Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.  You can contact them using their help line 0303 123113 or at www.ico.org.uk.

Data Access – You have the rights of access of your data held by us by simply notifying us by email info@whizzkidsnursery.com or post to Scout Way, Mill Hill, London NW7 3JW.

Data Accuracy - To have correct data recorded by our nursery.  We will be happy to correct errors that we have on our parents/children.

Data Erasion - To require our nursery to erase data which we hold about you as a parent/child or we will cease any consent-based processing of your personal data after you withdraw that consent.

9. Your Consent and Changes to Our Privacy Policy

By using our Site you consent to our collection and use of your personal information as described in this Policy. We reserve the right to amend this Policy at any time with or without notice. Any changes we may make to our Policy in the future will be posted on this page.

10. Amendment to Policy

This policy can be changed, modified, revised or can be rescinded completely by the company at any time with appropriate approvals.
